Temperature.

Explanation:

The simple answer is temperature. If the temperature at the ground is above freezing the precipitation will be liquid. If is is 10 degrees below freezing it will be solid (vast majority of the time anyway).

From the freezing point to 10 degrees below we can get freezing precipitation. This does not always occur, it depends on the temperature curve above the surface of the Earth. Freezing precipitation is liquid, it just freezes upon contact with the ground.
