It depends what you mean by human.

Anatomically modern human remains dating back approximately #200000# to #300000# years have been found.

Cro-Magnon man dates back to about #45000# years ago and exhibits typical human behaviour too, especially the use of stone tools.

The earliest cave paintings found in several sites range from about #35000# to #40000# years old.

So I guess you could say that we can be pretty confident that anatomically and behaviourally modern humans had arrived by about #40000# years ago, but possibly much earlier.
