Why would heat lost by warmer water not equal the heat gained by the colder water?

I don't know the context in which you ask your question. In all thermochemical experiments EVER performed, the heat energy is conserved. Given the circumstances of most experiments, some heat loss from the system to the surroundings is to be expected.
